BioMedStat LICENSE AGREEMENT

 

This agreement is entered into by you (either an individual or an entity) and Peterson Software Lab ("PSL"). If you do not agree to the terms of this agreement, then do not download this software.

 

SOFTWARE LICENSE FOR NON-PROFIT USE

 

1. GRANT OF LICENSE. Peterson Software Lab (PSL) grants you a 90-day non-exclusive and non-transferable license to use BioMedStat ("SOFTWARE") set forth herein. You must be a researcher at a non-profit (i.e., academic, government, etc.) institution. For fee-based licensing by commercial organizations or programming contracts, contact Dr. Leif E. Peterson. The license granted herein is limited to use of SOFTWARE on a single processing unit at any one time.  After downloading the SOFTWARE to a single processor unit, you may not transfer the SOFTWARE electronically or make it accessible, available or useable through a network, workgroup, e-mail, Internet or other form of electronic transmission.

If you want to extend the scope or time of the grant beyond that stated herein, you must request an extension by contacting Dr. Leif E. Peterson. Valid requests must include your name, address, telephone number, and e-mail address. After your request has been received, you will be contacted by a representative of PSL.

 

2. COPYRIGHT.  The software is owned by PSL and protected by United States copyright laws, international treaty provisions, and trade secrets.  Therefore, you must treat the SOFTWARE like any other material (e.g., book or musical recording) except that you may make one copy of the SOFTWARE for backup purposes and place the same copyright information on the backup copy. 

 

3. OTHER RESTRICTIONS.  The license granted herein shall not be assigned, sublicensed, or transferred, except in accordance with this agreement.  This agreement shall become binding and effective when you download this SOFTWARE. You may not reverse engineer, disassemble, modify, translate, disassemble, or decompile the software of any copy, in whole or in part.

 

DISCLAIMER OF WARRANTY

 

PSL makes no warranties whatsoever, express or implied, including any warranty of merchantability or fitness for a particular use. SOFTWARE is licensed as is and where is and, if proven defective, the user and not PSL assumes the entire cost of any service or repair.  Under no circumstances shall PSL be responsible for user error, including but not limited to, erroneous data input, misuse of SOFTWARE, and incorrect interpretation of data or missing data. Some states/jurisdictions do not allow limitations on duration of an implied warranty, so the above disclaimer may not apply to you.

 

NO LIABILITY FOR CONSEQUENTIAL DAMAGES

 

In no event shall PSL be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information (or other pecuniary loss) arising out of the use or inability to use

this PSL product, even if PSL has been advised of the possibility of such damages.

Since some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

                       

U.S. GOVERNMENT RESTRICTED RIGHTS

 

The SOFTWARE and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at 52.227-7013.  Manufacturer is PSL, Houston, Texas 77030.

 

This agreement is governed by the laws of the State of Texas.
